DEVELOPER NOKIA PROJECT HOSTING SERVICES TERMS OF USE
These Project Hosting Service Terms (“Project Hosting Terms”) are additional terms and conditions to the Developer Nokia Service Terms and Privacy Policy (collectively “Terms”). The Project Hosting Service Terms and the Terms govern the use of the Developer Nokia Project Hosting Services website and all related services (“Project Services”). If there is any conflict between these Project Hosting Terms and the Terms, the provisions of these Project Hosting Terms shall prevail when using Project Services.
By accessing, browsing or using the Project Services you (and the entity on behalf of which you are acting) agree to be bound by the Project Hosting Terms. If you (or the entity on behalf of which you are acting) do not agree to the Project Hosting Terms, you may not access or use the Project Services.
You acknowledge that Nokia may, at its sole discretion, update or modify these Project Hosting Terms in the future.
1. Definitions
For the purposes of the Project Hosting Terms the following terms shall have the meanings defined below:
"Associated Content" means any text, data, content, music, sound, photograph, graphic, video, message, comments or material submitted, posted or displayed through Project Services, but does not include Software.
“Project” means any project and/or repository operated by users for making (or allowing any third party to make) material (any such material, “User Content”) available by means of the Project Services;
"Software" means any software code submitted, posted, displayed or distributed via Project Services;
“User Content” means any Software or Associated Content.
2. Responsibility of Users
If you operate a Project, upload or post User Content or links to the Project Services, or otherwise make (or allow any third party to make) material available by means of the Project Services, you agree that you are responsible for your own conduct and any User Content that you create, post, upload or display while using Project Services and for any consequences thereof. You agree to use Project Services only for purposes that are legal, proper and in accordance with the Project Hosting Terms and the Terms and any applicable policies or guidelines. You agree that you will not engage in any activity that is harmful to or interferes with or disrupts Project Services or any servers or networks connected thereto.
To the extent you submit, upload or post User Content to Projects, you represent that you are the owner of such material or have authorization to license it in accordance with the open source or other licensing terms applicable to that Project.
You understand that all User Content is the sole responsibility of the person from which such User Content originated. You also understand that by using Project Services you may be exposed to User Content that is offensive, harmful, indecent or objectionable, and that you use Project Services at your own risk. Nokia has not reviewed, and cannot review, all the User Content posted to the Project Services, and cannot therefore be responsible for that User Content, its use or effects. By operating the Project Services, Nokia does not represent or imply that it endorses the User Content available, or that it believes such User Content to be accurate, useful, non-infringing or non-harmful.
Nokia reserves the right, but shall have no obligation, at its sole discretion, to (i) screen, review, flag, filter, refuse, modify or remove any User Content that, in Nokia’s reasonable opinion, violates the Project Hosting Terms or the Terms, or is in any way harmful or objectionable, or (ii) terminate or deny access to and use of the Project Services to any individual or entity for any reason. Nokia will have no obligation to provide a refund of any amounts previously paid.
3. Proprietary Rights to User Content
You or a third party licensor, as appropriate, retain all ownership and intellectual property rights to any User Content you submit, post or display on or through Project Services. Nokia claims no ownership of any User Content you submit to the Project Services. You or your third party licensor, as applicable, are responsible for protecting those rights, as appropriate.
4. Licensing of User Content
The User Content made available on the Project Services is for convenience and subject to the open source/free software or other licensing terms of their respective licensors as indicated in the respective source code files or other documents. Any use, reproduction, modification, redistribution and other intellectual property rights to User Content and other data hosted on Project Services shall be subject to the licensing terms accompanying or otherwise applicable to such Projects.
When starting to operate a Project, or submitting, posting, uploading or otherwise contributing User Content which is intended to be available to the members of the public, you must designate the license pursuant to which licensees obtain rights with respect to such User Content.
No implied rights or licenses, including without limitation any implied patent licenses, are granted by Nokia as a result of any Project or User Content being hosted on the Project Services. Each licensor grants the licenses to User Content as set forth in the applicable licenses and no assurances are provided by Nokia that the User Content so distributed/licensed does not infringe patent or other intellectual property rights of any other entity or that those licenses provide you with all the necessary rights to make use of the User Content available herein. For example, if a third party patent license is required to allow you to distribute or commercially make use of certain User Content made available on the Project Services, it is your responsibility to acquire the necessary licenses before such distribution or making use of the User Content.
Nokia disclaims any liability for claims brought by you or any other entity based on infringement of intellectual property rights or otherwise. You are hereby advised of these issues and therefore assume the sole responsibility to secure any other intellectual property rights and/or licenses that may be needed.
By submitting User Content to Nokia for inclusion on the Project Services, you hereby grant Nokia and its affiliates and sub-licensees a world-wide, perpetual, irrevocable, royalty-free, and non-exclusive license to use, copy, reproduce, modify, adapt, translate, communicate to the public, make available, display and publish such User Content for the purpose of displaying, making available, distributing and promoting your account, Project and User Content. If you delete User Content, Nokia will use reasonable efforts to remove it from the Project Services, but you acknowledge that caching or references to the User Content may not be made immediately unavailable.
You hereby represent and warrant that you have all rights, licenses and consents necessary to grant Nokia and other users the rights and licenses granted herein without infringement of any third party rights.
5. General Practices Regarding Use of the Project Services
Nokia retains the right, at its sole discretion, to create an upper limit on the number of transmissions you may send or receive through Project Services or the amount of storage space used at any time with or without notice. If your bandwidth usage for your account or Project significantly exceeds the average bandwidth usage of other users, as determined solely by Nokia, Nokia reserves the right to immediately disable your account or Project until the bandwidth consumption can be reduced.
You agree that Nokia has no responsibility or liability for the deletion or failure to store any User Content or other communications maintained on or transmitted via Project Services. While Nokia will use reasonable efforts to back up data and make such data available in the event of loss or deletion, Nokia has no responsibility or liability for the deletion or failure to store any communications or User Content maintained or transmitted on Project Services. Nokia encourages you to make and update frequently backup copies of your User Content.
